SmartIntel IA (hereinafter, the Platform or the Service) is owned and operated by Domingo Miguel Juan, based in Benicàssim (Castellón, Spain), with the contact email future@smartintelia.com.

By registering for or using SmartIntel IA, you accept these Terms and Conditions of Use.
If you do not agree, do not use the Platform.

1. Purpose

These Terms govern the access, use, and contracting of the services offered by SmartIntel IA: automatic generation of marketing materials, technical sheets and multilingual catalogues, trend analysis, and artificial-intelligence-based assistance for the wine and beverages sector.

2. Access Conditions

  • Access requires user registration with a valid email.

  • Use is restricted to individuals over 18 years of age.

  • SmartIntel IA reserves the right to suspend or cancel accounts for misuse, rule violations, or fraud.

3. Permitted Use

Users agree to:

  • Use the platform in accordance with the law and good faith.

  • Not upload unlawful, offensive, or unauthorized third-party images, texts, or data.

  • Not attempt to alter, copy, or redistribute the software or its outputs for unlawful purposes.

SmartIntel IA may temporarily or permanently block accounts that violate these rules.

4. Registration and Account

By creating an account, you agree to:

  • Provide truthful information and keep it updated.

  • Protect your login credentials.

  • Assume full responsibility for all actions performed through your account.

  • Receive marketing campaigns from the app.

You may request deletion of your account by emailing future@smartintelia.com.

5. Plans and Pricing

  • Standard plan: €250/month (VAT included).

  • Annual plan: €2,400 (VAT included, –20%).

  • Early Adopter: €125/month (VAT included, limited to 100 wineries). €1,500/year.

Prices may be updated with a 30-day prior notice.

Payments are securely processed through Stripe Inc.; SmartIntel IA does not store card data.

6. Free Trial

The 7-day free trial allows the use of all features without entering a card.
After the trial, you may select a paid plan to continue.
SmartIntel IA may cancel or modify this offer without prior notice.

7. Intellectual Property

All content, design, software, and materials generated by the Platform belong to SmartIntel IA or its licensors.

Users retain rights over their own data and images but grant SmartIntel IA a limited licence to process them solely for the purpose of providing the service.

8. Limitation of Liability

SmartIntel IA does not guarantee that the service will be uninterrupted or error-free, although it will take all reasonable measures to ensure continuity.
It is not responsible for indirect damages, loss of profits, or results derived from the use of the service.
Users access and use the Platform at their own risk.

9. Support and Maintenance

SmartIntel IA provides technical support via email at future@smartintelia.com.
Incidents will be addressed during business hours (CET).
Updates may be carried out without notice to improve performance or security.

10. Data Protection

The processing of personal information is governed by the Privacy Policy, which forms an integral part of these Terms.

11. Third-Party Services

SmartIntel IA integrates with external tools:

Mailerlite.com (automation and marketing), Base44 Ltd. (hosting and analytics), Google LLC (cloud and email services), and Stripe Inc. (payments).

Each provider applies its own security and privacy policies in compliance with GDPR.

12. Suspension or Cancellation

SmartIntel IA may suspend access due to maintenance, non-payment, or misuse.
Users may cancel their subscription at any time; no refunds will be issued for periods already started except in cases attributable to SmartIntel IA.

13. Ownership and Licence of Generated Content

Content generated with the application (sheets, texts, catalogues) may be freely used by the user for commercial purposes.
SmartIntel IA may use anonymous examples for demonstration or statistical purposes, without revealing identifiable data.

14. Governing Law and Jurisdiction

These Terms are governed by Spanish law.
The parties submit to the Courts and Tribunals of Castellón (Spain), unless mandatory regulations require another jurisdiction.
